BATON ROUGE, LA - Louisiana Attorney General Jeff Landry today joined a brief to the United States Supreme Court in support of the Trump Administration’s decision to wind down the Obama-era Deferred Action for Childhood Arrivals (DACA) program, which granted lawful presence and work permits to nearly one million unlawfully present aliens without Congressional authorization. 

“DACA does much more than simply exercise enforcement discretion by deferring deportation proceedings; it affirmatively confers ‘lawful presence’ status and work-authorization eligibility to hundreds of thousands of aliens,” explained General Landry. “DACA is thus materially identical to two programs (Expanded DACA and DAPA) that were invalidated by the Fifth Circuit in a ruling affirmed by an equally divided vote of the Supreme Court.”

“So the Supreme Court must decide once again whether the Executive Branch can simply sidestep the people’s elected representatives in the Legislative Branch,” said General Landry. “As a strong supporter of the separation-of-powers, I hope they side with the Constitution and move toward ending this executive amnesty.”

Joining General Landry in this brief are the Attorneys General of Alabama, Arkansas, Arizona, Florida, Kansas, Louisiana, Nebraska, South Carolina, South Dakota, Texas, and West Virginia; and the Governors of Maine and Mississippi.
